Opinion: Mos Def arrested... Political or not?

Okay, this over a week too late, but not many people seem to know about the incident, so here it goes...
Rapper, Dante Smith aka. Mos Def, was arrested on August 31st right in the middle of a performance on the streets outside the MTV Video Music Awards.
According to the police department, Mos Def was arrested for operating a sound reproduction device without a permit. Oh what a crock of ssssshhhhh....
The reason I say this is that Def was performing a song dedicated to the Hurricane Katrina incident. The song contained blatent criticism towards George Bush.
A spokeswoman for Mos Def said that he was wrongfully arrested. He did not plan on doing anything wrong and simply wanted to remind people of Katrina and pay homage to the brutal hurricane's victims.
What I found disturbing was the fact that it was on the street outside the MTV Music Video Awards. For over a decade, unsactioned gigs have played outside the funky awards night. So why was Mos Def pulled up for this?
Bush says that the Iraqi war and the current situation in Iran are all for the benefit of democracy. What is democracy? Isn't it liberty, freedom, and the ability to voice your opinions? I don't see the democratic nature in the Mos Def arrest.
His ability to voice his opinions on the Hurricane Katrina situation was nullified, effectively silencing his democratic right.
Is there such thing as Democracy? I'll leave that up to you guys.
